Welcome to WholesomePsych! These Terms and Conditions (“Terms”) govern your use of WholesomePsych’s website and telehealth services. By accessing or using our services, you agree to comply with these Terms. If you do not agree, please refrain from using our platform.

Eligibility and Use
To use WholesomePsych’s services:
- You must be at least 18 years old or have a legal guardian’s consent.
- You must be physically located in the State of California during service delivery.
You are responsible for maintaining the confidentiality of your login credentials. WholesomePsych is not liable for unauthorized access resulting from your failure to secure your account.
Services Provided
We provide mental health services, including:
- Online therapy
- Psychiatry
- Medication management via telehealth
We do not provide services for:
- Medical emergencies
- Detoxification or intensive substance abuse treatment
- Physical assessments required by the court or legal matters
For emergencies, call 911 or go to the nearest ER. Services are subject to change or discontinuation without notice.
Telehealth Consent
By engaging with WholesomePsych, you voluntarily consent to receive healthcare services via telehealth, which refers to the use of secure telecommunications technology to deliver mental health care remotely. This may include:
- Live video sessions
- Telephone consultations
- Secure messaging through our platform or designated systems.
Telehealth allows you to access care from the comfort and privacy of your own space, eliminating the need for travel, reducing wait times, and increasing continuity of care. It is a flexible and effective option for many mental health conditions and therapy goals.
We use HIPAA-compliant platforms to protect your personal information and maintain confidentiality during all sessions. Your provider will explain the format and expectations for remote visits, and you’ll have the opportunity to ask questions at any point.
Limitations of Telehealth Services
While telehealth offers many advantages, it also has important limitations:
- Technical issues, such as unstable internet connections, may interrupt sessions.
- Providers cannot perform physical exams or detect certain physical signs that might be visible during in-person interactions.
- Some forms of treatment, like detoxification or crisis stabilization, are not appropriate via telehealth.
You should not use our platform in situations involving:
- Immediate risk to self or others
- Suicidal or homicidal thoughts
- Medical emergencies
In such cases, please call 911, go to your nearest emergency room, or contact the Suicide & Crisis Lifeline at 988.
Additionally, WholesomePsych’s telehealth services may not meet all legal or institutional requirements. We do not provide:
- Court-mandated therapy
- Documentation for legal proceedings or disability claims
- Evaluations requiring in-person examination or diagnostics
If you begin services and later determine that a different form of care is needed, you have the right to withdraw from treatment at any time. Our team can assist with referrals or additional resources to help you find the best fit for your needs.
Privacy and Data Protection
HIPAA Compliance
We comply with the Health Insurance Portability and Accountability Act (HIPAA). Your Protected Health Information (PHI) is confidential and used only for your care or coordination unless you provide authorization otherwise. You have the right to:
- View and request a copy of your PHI
- Request corrections
- Revoke information sharing at any time.

CCPA Compliance
Under the California Consumer Privacy Act (CCPA), you have rights to:
- Know what data we collect
- Access or delete your data
- Opt out of data sales (we do not sell user data)

User Responsibilities
You agree to:
- Provide accurate and current information
- Use services ethically and legally.
- Avoid disruptive, harassing, or unlawful behavior.
Notify us of changes in health, medication, insurance, or intent to discontinue treatment
Appointments & Attendance Policy
Regular attendance is critical for effective treatment. By scheduling with us, you agree to:
- Cancel/reschedule at least 24 hours in advance (call during business hours)
- Reschedule within 7 days of cancellation when possible.
- Arrive on time; 15+ minutes late may result in a missed session.
- Pay a $25 no-show fee for late cancellations or no-shows.
You may be discharged after:
- 3 consecutive missed sessions
- Repeated late arrivals or erratic scheduling
Inconsistent participation
Payment and Insurance
We accept:
- Insurance (primary and secondary)
- Self-pay options
- HSA/FSA payments
Patient responsibilities:
- Co-pays are due at the time of service
- Notify us of insurance changes.
- Secure necessary referrals (e.g., from a PCP)
- Fees for forms/paperwork start at $5
- Returned check fee: $20
- Balances unpaid after 90 days may be sent to collections.
- Treatment may be paused for nonpayment.
If you are uninsured, we offer payment plans — consistent, timely payments are required to maintain care.
Medication and Controlled Substances Policy
Medication management requires:
- Attending scheduled appointments
- Reporting changes from other providers
- Signing releases for care coordination
Controlled substances:
- Maximum daily doses apply (see full controlled substance policy)
- No early refills, replacements, or pharmacy transfers (except for shortages)
- Urine/blood screenings may be required.
- No prescribing if also on opioids or without clearance (e.g., EKG for stimulants)
- Non-compliance or misuse may result in discharge.
Certain medications (e.g., gabapentin, hypnotics, suboxone) are restricted or not prescribed.
Intellectual Property
All website content is owned by WholesomePsych. You may not reuse, copy, or distribute materials without written permission.
Disclaimer of Warranties
Our services are provided “as is” and “as available” without guarantees of specific outcomes. We strive to offer excellent care, but we cannot promise results due to the unique nature of mental health treatment.
Limitation of Liability
To the fullest extent permitted:
- WholesomePsych is not liable for indirect, incidental, or consequential damages.
Liability is limited to the amount paid for services or as defined by California law.
Indemnification
You agree to hold harmless WholesomePsych, its staff, and affiliates against claims arising from misuse of our platform or violation of these Terms.
Termination of Services
We may terminate your care if:
- You engage in disruptive, abusive, or unsafe behavior
- You fail to follow treatment plans or attend appointments.
- You use services to seek controlled substances improperly.
- You refuse to comply with financial agreements or medication policies.
Termination will follow professional and legal guidelines. Continuity of care will be supported when possible.
Changes to Terms
These Terms may be updated at any time. Material changes will be announced via email or on our website. Continued use signifies your acceptance of updates.
